3.1.6In particular, if you choose to register as BEST MY’s driver either directly with us or through our business partner / agent: name, surname, signature, date of birth, national ID card number, address shown on the national ID card, address of residence, current address, mobile phone number, information about the use of electronic systems such as IP address, browser type and cookies, conversation history in various applications, and sensitive personal data such as biometric data from your face scan, work location, vehicle plate number, vehicle license, your employer, identity card, real-time GPS locations, access to camera and gallery storage functions of your mobile phones etc.;
3.1.7In particular, if you choose to register as BEST MY’s end user to deliver or receive goods or parcels: your name, surname, signature, date of birth, national ID card number, address shown on the national ID card, address of residence, current address, mobile phone number, information about the use of electronic systems such as IP address, browser type and cookies, conversation history in various applications, and sensitive personal data such as biometric data from your face scan, photos of your goods or parcels, of you or of your premises as proof of delivery;
3.1.8Supporting documents provided to us during the engagement with us;

3.1.10Any other information that may be reasonably required to facilitate your engagement with us or the delivery of product and/or service to you.

Bhd. bersama sekutu-sekutunya (“YINGSOFTWARE MY” atau “kami”), kami menghargai privasi anda dan berusaha untuk melindungi maklumat peribadi anda mengikut undang-undang Malaysia. Notis Perlindungan Data Peribadi Dan Dasar Privasi ini (“Dasar Privasi”) menjelaskan bagaimana kami mengumpul, menyimpan, menggunakan, berkongsi, memproses, dan melupuskan maklumat peribadi pengguna (“pengguna” atau “anda”) mengikut Akta Perlindungan Data Peribadi 2010 ("PDPA") dan undang-undang Malaysia.
14.2Privasi anda penting bagi kami, sila baca Dasar Privasi ini untuk memahami bagaimana kami menggunakan maklumat peribadi yang dikumpulkan daripada anda. 16.1.6Khususnya, jika anda mendaftar sebagai pemandu YINGSOFTWARE MY, sama ada secara langsung dengan kami atau melalui rakan kongsi perniagaan/ ejen kami: nama, nama keluarga, tandatangan, tarikh lahir, nombor kad pengenalan nasional, alamat yang tertera pada kad pengenalan nasional, alamat tempat tinggal, alamat semasa, nombor telefon bimbit, maklumat mengenai penggunaan sistem elektronik, seperti alamat IP, jenis pelayar, dan kuki, sejarah perbualan dalam pelbagai aplikasi, dan data peribadi sensitif seperti data biometrik daripada imbasan wajah, lokasi kerja, nombor plat kenderaan, lesen kenderaan, majikan anda, kad pengenalan, lokasi GPS masa nyata, akses kepada fungsi kamera dan penyimpanan galeri telefon bimbit anda dan sebagainya;
16.1.7Khususnya, jika anda memilih untuk mendaftar sebagai pengguna akhir YINGSOFTWARE MY untuk menghantar atau menerima barang atau bungkusan: nama, nama keluarga, tandatangan, tarikh lahir, nombor kad pengenalan nasional, alamat yang tertera pada kad pengenalan nasional, alamat tempat tinggal, alamat semasa, nombor telefon bimbit, maklumat mengenai penggunaan sistem elektronik seperti alamat IP, jenis pelayar, dan kuki, sejarah perbualan dalam pelbagai aplikasi, serta data peribadi sensitif seperti data biometrik daripada imbasan wajah anda, gambar barangan atau bungkusan anda, anda sendiri atau premis anda sebagai bukti penghantaran;
16.1.8Dokumen sokongan yang diberikan kepada kami semasa berurusan dengan kami;
16.1.9Semua maklumat mengenai produk dan/atau perkhidmatan yang anda peroleh daripada kami; dan
16.1.10Sebarang maklumat lain yang mungkin diperlukan secara munasabah untuk memudahkan urusan anda dengan kami atau penghantaran produk dan/atau perkhidmatan kepada anda.
17.17.SUMBER PENGUMPULAN DATA PERIBADI
17.1Kami mungkin mengumpul maklumat peribadi secara langsung daripada anda, wakil yang diberi kuasa oleh anda, atau daripada sumber yang tersedia secara umum:
17.1.1Apabila anda menggunakan, meminta, membeli atau menerima mana-mana produk dan/atau perkhidmatan daripada kami;
17.1.2Apabila anda berkomunikasi dengan kami (contohnya apabila anda menghantar borang hubungan di laman web kami, atau apabila anda menghubungi kami untuk sebarang pertanyaan melalui telefon, sembang langsung atau sistem lain yang dioperasikan oleh YINGSOFTWARE MY);

17.1.7Apabila anda menjadi pemandu untuk menyediakan Perkhidmatan untuk YINGSOFTWARE MY, sama ada secara langsung dengan kami atau melalui rakan perniagaan/agen kami;
17.1.8Apabila anda melawat mana-mana pejabat kami atau pejabat agen kami;
17.1.9Apabila anda melawat atau melayari laman web dan/atau aplikasi mudah alih kami;
17.1.10Apabila anda membuat aduan kepada kami;
17.1.11Apabila anda memberikan maklum balas kepada kami;
17.1.12Apabila anda adalah penerima penghantaran yang dihantar oleh kami; dan
17.1.13Apabila anda berinteraksi dengan kami melalui media sosial atau aplikasi interaktif termasuk tetapi tidak terhad kepada Facebook, Twitter, dan Instagram.
17.2Selain daripada maklumat peribadi yang diperoleh secara langsung daripada anda (seperti yang diperincikan di atas), kami juga mungkin memperoleh maklumat peribadi anda daripada pihak ketiga yang kami berurusan atau sumber lain di mana anda telah memberikan kebenaran untuk pendedahan Data Peribadi yang berkaitan dengan anda, dan/atau di mana ia dibenarkan secara sah.
17.3Untuk pelayaran web secara am, walaupun tiada Data Peribadi didedahkan kepada kami, maklumat teknikal dan statistik tertentu tersedia kepada kami melalui penyedia perkhidmatan internet kami.

Maklumat penggunaan teknikal
Apabila anda melawat laman web atau aplikasi mudah alih kami, kami secara automatik mengumpulkan maklumat yang dihantar kepada kami oleh computer, telefon bimbit, atau peranti akses lain anda. Maklumat ini termasuk: alamat IP, maklumat peranti (contohnya jenis pelayar dan jenis sistem operasi); maklumat log (cara, jenis, dan status rangkaian yang diakses, data kualiti rangkaian, maklumat log operasi seperti maklumat laman web, pandangan individu di laman web, halaman atau ciri yang diakses dan pautan yang diklik, jumlah masa yang digunakan pada halaman tertentu, pergerakan tetikus, log ralat, maklumat kesalahan perkhidmatan, dan bagaimana peranti anda berinteraksi dengan laman web, produk, atau perkhidmatan kami, data kualiti rangkaian, maklumat kesalahan perkhidmatan), maklumat web standard (jenis pelayar dan halaman yang anda akses di Laman Web kami).
17.3.2
Kuki
Kami mengumpul maklumat tentang penggunaan laman web kami melalui kuki dan teknologi serupa yang lain (contohnya suar web, fail log, skrip, dan eTag) ("Kuki"). Kuki adalah paket maklumat elektronik yang disimpan di komputer anda dan digunakan oleh laman web untuk menjejaki pelawat dan pengguna berdaftar, dan ini adalah salah satu kaedah untuk menjejak pelawat secara unik untuk pelbagai tujuan. E-mel ini mengandungi penjejakan khas yang membantu kami menyediakan komunikasi pemasaran yang lebih fokus kepada anda.

Sila ambil maklum bahawa Dasar Privasi ini hanya terpakai kepada laman web YINGSOFTWARE MY dan tidak terpakai kepada mana-mana laman web pihak ketiga yang anda akses daripada laman web kami. Untuk mengetahui bagaimana mereka mengendalikan maklumat peribadi anda, sila pastikan anda membaca dasar privasi mereka masing-masing.
18.PENGGUNAAN MAKLUMAT PERIBADI
18.1Anda bersetuju bahawa kami boleh menggunakan maklumat peribadi anda seperti yang dibenarkan oleh undang-undang yang terpakai, untuk satu atau lebih tujuan berikut:

18.1.1Untuk menyediakan produk dan/atau perkhidmatan yang anda minta.

18.1.4Untuk menyiasat dan menyelesaikan sebarang isu perkhidmatan.
18.1.5Untuk terlibat dalam urus niaga perniagaan berkaitan produk dan/atau perkhidmatan yang ditawarkan dan disediakan kepada anda.
18.1.6Untuk mengekalkan dan membangunkan sistem perniagaan dan infrastruktur kami, termasuk pengujian dan peningkatan sistem ini.
18.1.7Untuk membantu kami memantau dan meningkatkan prestasi produk dan perkhidmatan kami, pasukan perkhidmatan pelanggan kami, laman web dan aplikasi mudah alih kami.
Komunikasi
18.1.8Untuk menghantar notifikasi kepada anda melalui e-mel, panggilan telefon, faks, perkhidmatan pesanan ringkas, media sosial dan perkhidmatan lain mengenai perubahan terma dan syarat produk dan/atau perkhidmatan kami.
18.1.9Untuk menghantar notifikasi kepada anda melalui e-mel, panggilan telefon, perkhidmatan pesanan ringkas, notifikasi sokongan akaun (dalam aplikasi) berkaitan pengambilan dan mesej lain berkaitan penghantaran.
18.1.10Untuk mengemas kini status penghantaran.
18.1.11Untuk menjawab pertanyaan, aduan, atau pertanyaan lain.
Pentadbiran
18.1.12Untuk mengesahkan identiti anda, mencipta dan mentadbir akaun anda.
18.1.13Untuk memproses permohonan, permintaan, pendaftaran atau langganan perkhidmatan yang disediakan oleh kami dan/atau penggunaan laman web/aplikasi mudah alih kami.
18.1.14Untuk menguruskan latihan kakitangan dan jaminan kualiti.
18.1.15Untuk pengurusan risiko kredit dan penilaian kesahihan pengguna YINGSOFTWARE MY.
18.1.16Untuk rekod dalaman dan penyelenggaraan pangkalan data pengguna kami.
18.1.17Untuk mewujudkan dan menguruskan hubungan perniagaan yang lebih baik dengan anda.
18.1.18Untuk menganalisis penggunaan dan aktiviti berkaitan dengan laman web dan perkhidmatan kami.
18.1.19Untuk menyelesaikan masalah dan meningkatkan laman web serta aplikasi mudah alih kami.
Analisis Pemasaran
18.1.20Untuk menjalankan aktiviti pemasaran (contohnya, penyelidikan pasaran).
18.1.21Untuk memaklumkan anda mengenai faedah dan perubahan kepada ciri-ciri produk dan/atau perkhidmatan kami.
18.1.22Untuk pengurusan sistem maklumat, pengujian sistem, penyelenggaraan, dan pembangunan produk dan/atau perkhidmatan kami.
Pematuhan Undang-Undang
18.1.23Untuk menguatkuasakan terma dan syarat kami serta perjanjian lain, termasuk penyiasatan terhadap sebarang pelanggaran yang berpotensi;
18.1.24Untuk melindungi hak, harta atau keselamatan kami, pengguna kami, pihak ketiga atau orang awam seperti yang dikehendaki atau dibenarkan oleh undang-undang.
18.1.25Untuk mengesan, mencegah dan melaporkan sebarang aktiviti jenayah termasuk, tetapi tidak terhad kepada, penipuan, rasuah, dan pengubahan wang haram.
18.1.26Untuk menyiasat, bertindak balas, atau mempertahankan tuntutan yang dibuat terhadap atau melibatkan YINGSOFTWARE MY;
18.1.27Untuk mengekalkan rekod yang diperlukan untuk tujuan keselamatan, tuntutan atau tujuan undang-undang lain.
18.1.28Untuk mematuhi sebarang keperluan undang-undang untuk membuat pendedahan yang dikehendaki atau dibenarkan oleh mana-mana undang-undang, peraturan, garis panduan dan/atau pihak berkuasa kawal selia yang berkaitan.
19.PENDEDAHAN MAKLUMAT PERIBADI
19.1Kecuali seperti yang dinyatakan di bawah Dasar Privasi ini, kami memberi jaminan bahawa YINGSOFTWARE MY tidak akan membekalkan, menjual, menyewa, atau memajak maklumat peribadi anda kepada mana-mana pihak ketiga dan akan memastikan semua maklumat kekal sulit. Walau bagaimanapun, kami mungkin perlu atau dikehendaki mendedahkan maklumat mengenai anda kepada pihak ketiga berikut:
19.1.1Syarikat induk, anak syarikat, dan sekutu-sekutu kami;
19.1.2Individu-individu, syarikat-syarikat, dan/atau organisasi-organisasi yang bertindak sebagai ejen, pemandu, kontraktor, penyedia perkhidmatan, dan/atau penasihat profesional kami;
19.1.3Syarikat-syarikat, dan/atau organisasi-organisasi yang membantu kami dalam memproses dan/atau melaksanakan transaksi serta menyediakan anda dengan produk dan/atau perkhidmatan yang telah anda minta atau langgani;
19.1.4Peniaga-peniaga dan/atau rakan-rakan strategik kami yang menyediakan anda dengan produk dan/atau perkhidmatan yang memerlukan pendedahan maklumat peribadi;
19.1.5Rakan-rakan perniagaan kami dan pihak-pihak lain yang menyediakan perkhidmatan yang berkaitan dengan tujuan pengumpulan maklumat peribadi anda, contohnya perkhidmatan pemprosesan data;
19.1.6Penyedia perkhidmatan pihak ketiga kami sebagaimana yang kami anggap perlu atau sesuai;

19.1.9Mana-mana agensi pelaporan kredit atau, jika berlaku kegagalan pembayaran, mana-mana agensi pemungut hutang yang tertakluk kepada undang-undang yang terpakai kepada kami;
19.1.10Pihak lain yang mana anda telah memberikan persetujuan secara jelas atau tersirat;
19.1.11Badan-badan kehakiman, penguatkuasaan, peraturan dan agensi kerajaan seperti yang dikehendaki oleh undang-undang; dan
19.1.12Mana-mana pihak ketiga yang memperoleh keseluruhan atau sebahagian besar daripada kami atau perniagaan kami.
19.2Harap maklum bahawa untuk tujuan yang dinyatakan di atas, Data Peribadi anda mungkin dipindahkan ke lokasi di luar Malaysia atau didedahkan kepada syarikat berkaitan atau syarikat induk kami, pemegang-pemegang lesen, rakan-rakan perniagaan dan/atau penyedia perkhidmatan kami, yang mungkin terletak di dalam atau di luar Malaysia. Anda bersetuju dan memberi kebenaran untuk pemindahan Data Peribadi anda keluar dari Malaysia seperti yang dinyatakan di sini.

19.4Kami juga mungkin mendedahkan maklumat anda kepada pihak ketiga jika kami: (a) menjual, memindahkan, menggabungkan, menyatukan atau menyusun semula mana-mana bahagian perniagaan kami, atau bergabung, memperoleh atau membentuk usaha sama dengan mana-mana perniagaan lain, dalam hal ini kami mungkin mendedahkan data anda kepada mana-mana pembeli, pemilik baru, atau pihak ketiga yang terlibat dalam perubahan kepada perniagaan kami; atau (b) menjual atau memindahkan mana-mana aset kami, dalam hal ini maklumat yang kami pegang tentang anda mungkin dijual sebagai sebahagian daripada aset tersebut dan mungkin dipindahkan kepada mana-mana pembeli yang berpotensi, pemilik baru, atau pihak ketiga lain yang terlibat dalam jualan atau pemindahan tersebut.
20.LANGKAH PENYIMPANAN DAN KESELAMATAN
20.1Menurut kontrak kami dengan anda untuk menyediakan Perkhidmatan kepada anda, maklumat peribadi anda akan diproses pada server yang mungkin tidak terletak di tempat anda tinggal. Tidak kira di mana server kami berada, kami mengambil langkah-langkah yang sesuai untuk melindungi hak anda selaras dengan Dasar Privasi ini.
20.2Server kami untuk Perkhidmatan terletak di Singapura.
20.3Selain itu, pasukan sokongan, kejuruteraan, dan pasukan lain kami terletak di pejabat-pejabat kami di seluruh dunia (termasuk Republik Rakyat China (untuk tujuan Dasar Privasi ini tidak termasuk Wilayah Pentadbiran Khas Hong Kong dan Wilayah Pentadbiran Khas Macau) (“PRC”) dan di tempat anda tinggal, dan akan mempunyai akses kepada maklumat anda. Kami akan mengambil semua langkah yang munasabah dan perlu untuk memastikan bahawa Data Peribadi anda diperlakukan dengan selamat dan selaras dengan dasar ini.
20.4Sebaik sahaja kami menerima data peribadi anda, kami akan menggunakan semua tindakan praktikal yang munasabah dan langkah-langkah keselamatan seperti yang dikehendaki di bawah undang-undang yang berkenaan, untuk memastikan bahawa data peribadi anda disimpan dengan selamat dan dilindungi oleh kami daripada akses, pemprosesan, pengubahsuaian, pemadaman, kehilangan, atau penggunaan yang tidak sah atau tidak sengaja:
20.4.1Data peribadi anda akan disimpan secara sulit dan selamat kecuali untuk tujuan dan penggunaan yang dinyatakan dalam Dasar Privasi ini dan hanya akan didedahkan berdasarkan keperluan.
20.4.2Jika kami menyerahkan Data Peribadi anda kepada pemproses data secara luar, kami akan menggunakan cara kontrak dan lain-lain untuk memantau pematuhan pemproses data terhadap Dasar Privasi ini.
20.4.3Kami telah mengguna pakai langkah-langkah keselamatan organisasi, fizikal, dan teknikal yang selaras dengan piawaian industri untuk melindungi data peribadi yang anda berikan.
20.5Malangnya, penghantaran maklumat melalui internet atau e-mel tidak sepenuhnya selamat. Walaupun kami akan melakukan yang terbaik untuk melindungi Data Peribadi anda, kami tidak dapat menjamin keselamatan maklumat anda yang dihantar melalui internet atau e-mel; sebarang penghantaran adalah atas risiko anda sendiri.
20.6Dari semasa ke semasa, kami akan menyediakan pautan ke dan dari aplikasi atau laman web sekutu kami atau pihak ketiga. Jika anda mengikuti pautan ke mana-mana aplikasi atau laman web tersebut, aplikasi atau laman web tersebut akan mempunyai dasar-dasar privasi mereka sendiri dan kami tidak bertanggungjawab atau menanggung liabiliti ke atas dasar-dasar tersebut. Sila semak dasar-dasar tersebut sebelum anda menyerahkan sebarang maklumat kepada aplikasi atau laman web tersebut.
20.7Anda bertanggungjawab untuk memastikan kata laluan akaun anda kekal sulit. Anda tidak boleh membongkar atau mendedahkan kata laluan akaun anda kepada mana-mana pihak ketiga. Sila maklumkan kepada kami dengan segera jika anda percaya bahawa kata laluan atau rekod anda telah dikompromi.
21.TEMPOH PENYIMPANAN DATA PERIBADI
21.1Sebarang data peribadi yang anda berikan akan disimpan oleh YINGSOFTWARE MY selagi diperlukan dan sesuai untuk memenuhi apa-apa tujuan seperti yang dinyatakan di atas, selaras dengan amalan dalaman, keperluan peraturan, keperluan undang-undang dan perakaunan kami.
21.2Selepas anda menamatkan penggunaan Perkhidmatan kami, kami akan menyimpan maklumat anda dalam format yang digabungkan dan tanpa nama.
22.HAK ANDA
22.1Anda mempunyai hak tertentu berkaitan dengan maklumat peribadi yang kami pegang tentang anda.
Akses
22.1.1Anda mempunyai hak untuk mengakses Data Peribadi yang kami pegang tentang anda dan diberikan maklumat mengenai Data Peribadi subjek data yang sedang diproses oleh kami.
Pembetulan
22.1.2Anda juga mempunyai hak untuk meminta kami untuk membetulkan Data Peribadi anda sekiranya ia tidak tepat, tidak lengkap, mengelirukan, atau tidak dikemas kini.
Penarikan Balik Persetujuan
22.1.3Anda juga boleh menarik balik persetujuan anda untuk pemprosesan Data Peribadi di mana anda adalah subjek data.
Menghalang Pemprosesan
22.1.4Anda juga mempunyai hak untuk menghendaki kami untuk memberhentikan atau tidak memulakan pemprosesan atau pemprosesan bagi suatu maksud yang tertentu atau mengikut cara yang tertentu ke atas Data Peribadi anda jika pemprosesan tersebut menyebabkan atau mungkin menyebabkan kerosakan yang substansial atau distres yang substansial kepada anda atau kepada orang lain dan kerosakan atau distres itu adalah atau akan menjadi tidak wajar..

22.1.6Apabila anda mencipta akaun di laman web atau aplikasi mudah alih YINGSOFTWARE MY, anda melanggan secara automatik untuk menerima notis transaksi, surat berita e-mel, dan berita mengenai promosi istimewa yang ditawarkan oleh YINGSOFTWARE MY. Untuk berhenti melanggan surat berita dan surat promosi kami, anda boleh menekan pautan yang disediakan dalam mesej e-mel promosi yang dihantar kepada anda atau menghubungi pasukan sokongan kami.
22.2Anda boleh menghantar permintaan anda secara bertulis atau melalui e-mel kepada butiran hubungan yang disediakan di bawah.
22.3Jika terdapat sebarang perubahan pada Data Peribadi anda atau jika anda ingin membuat permintaan untuk mengakses atau membetulkan Data Peribadi anda, anda boleh membuat permintaan kepada kami melalui borang permintaan akses data peribadi.pdf atau borang permintaan pembetulan data peribadi.pdf yang berkaitan, di mana kami akan berusaha dengan sewajarnya untuk mematuhi dalam tempoh dua puluh satu (21) hari selepas menerima permintaan anda dan yuran pemprosesan yang berkaitan (jika ada).
22.4Harap maklum bahawa kami mungkin menolak untuk mematuhi permintaan anda dalam situasi tertentu, contohnya apabila kami tidak dapat mengesahkan identiti anda, apabila maklumat yang diminta adalah maklumat komersial yang sulit, atau jika kami menerima permintaan berulang untuk maklumat yang sama atau sebarang sebab lain yang dibenarkan oleh undang-undang.
23.KEWAJIPAN ANDA
23.1Di mana dinyatakan (contohnya dalam borang pendaftaran/permohonan sama ada melalui laman web kami, platform media sosial, atau borang fizikal di pejabat YINGSOFTWARE MY atau pejabat agen kami), anda diwajibkan untuk memberikan maklumat peribadi anda kepada kami bagi membolehkan kami memproses permohonan anda untuk produk dan/atau perkhidmatan kami. Sekiranya anda enggan memberikan maklumat peribadi yang wajib tersebut, kami mungkin tidak dapat memproses permohonan anda atau menyediakan produk dan/atau perkhidmatan kepada anda.
23.2Anda bertanggungjawab untuk memberikan maklumat yang tepat dan lengkap kepada kami mengenai diri anda (atau mana-mana individu lain yang maklumat peribadinya anda berikan kepada kami) serta memastikan maklumat peribadi ini adalah paling terkini dengan membekalkan kemas kini yang berkaitan kepada butiran hubungan yang dinyatakan di bawah. Kewajipan ini adalah syarat untuk penyediaan produk dan/atau perkhidmatan kami kepada anda dan/atau mana-mana individu lain yang yang diberi kuasa atau dibenarkan oleh anda atau organisasi/syarikat anda untuk menggunakan produk dan/atau perkhidmatan tersebut.
23.3Jika anda tidak mahu maklumat anda dikumpulkan melalui kuki di laman web YINGSOFTWARE MY, anda boleh menyahaktifkan kuki dengan menyesuaikan tetapan pelayar internet anda untuk menyahdaya, menyekat atau menyahaktifkan kuki, dengan memadamkan sejarah pelayaran anda, dan membersihkan cache dari pelayar internet anda.
23.4Sekiranya anda perlu memberikan maklumat peribadi berkaitan dengan pihak ketiga kepada kami (contohnya mengenai ahli keluarga, rakan, atau orang yang ditugaskan e.g. dari organisasi atau syarikat) untuk membolehkan mereka berurusan secara langsung dengan kami, anda dikehendaki untuk (i) mendapatkan persetujuan mereka atau mempunyai hak untuk memberikan maklumat peribadi mereka kepada kami dan membenarkan kami menggunakannya sewajarnya, dan (ii) memberitahu mereka untuk membaca Dasar Privasi ini di laman web kami.

25.KEMASKINI DASAR PRIVASI
25.1Kami mungkin meminda Dasar Privasi ini dari semasa ke semasa dan versi yang dikemas kini akan terpakai serta menggantikan semua versi terdahulu, termasuk tetapi tidak terhad kepada risalah atau versi cetakan. Sila semak laman web kami untuk mengetahui amalan kami yang paling terkini.
26.BAHASA
26.1Kecuali sebagaimana yang ditetapkan oleh undang-undang, sekiranya terdapat sebarang percanggahan atau ketidakselarasan antara versi Bahasa Inggeris dan versi Bahasa Melayu Dasar Privasi ini, versi Bahasa Inggeris akan diguna pakai.

Giới thiệu
Điều khoản và Điều kiện Bảo mật này ("Điều khoản và Điều kiện") quy định việc thu thập, sử dụng và bảo vệ dữ liệu cá nhân do người lái xe ("Người dùng") cung cấp khi đăng nhập và sử dụng ứng dụng di động Phiên bản Điều Hành Phương Tiện QTMS ("Ứng dụng") được phát hành bởi Công ty TNHH Best Express (Việt Nam).
Vì mục đích của Điều khoản và Điều kiện này, thuật ngữ "Best Inc" sẽ chỉ đến Công ty TNHH Best Express (Việt Nam) cũng như bất kỳ công ty liên kết nào mà Công ty TNHH Best Express (Việt Nam) hoặc các công ty con của nó nắm giữ quyền sở hữu.
Bằng cách đăng nhập vào Ứng dụng, Người dùng đồng ý với các điều khoản được nêu trong Điều khoản và Điều kiện này như sau:

Dữ liệu cá nhân của Người dùng được thu thập được sử dụng để phục vụ nhiều chức năng quan trọng trong hoạt động của chúng tôi, đảm bảo cả sự an toàn của dịch vụ và hiệu quả của các quy trình. Những điều này bao gồm:
Xác thực Người dùng:
Dữ liệu cá nhân được sử dụng để xác minh và xác nhận danh tính của Người dùng. Điều này rất quan trọng trong quá trình đăng nhập và trong suốt quá trình sử dụng nền tảng của chúng tôi để ngăn chặn việc truy cập trái phép và đảm bảo rằng Người dùng là người mà họ tuyên bố. Quy trình này liên quan đến việc sử dụng các thông tin xác thực như tên người dùng, mật khẩu và các thông tin nhận dạng khác.
Báo cáo Đơn hàng và Hoạt động:
Dữ liệu được sử dụng để tạo báo cáo toàn diện về các hoạt động khác nhau mà Người dùng thực hiện. Điều này bao gồm báo cáo việc chấp nhận đơn hàng, thu gom hàng hóa, ký tài liệu giao hàng và xác định cũng như báo cáo bất kỳ vấn đề hoặc bất thường nào có thể phát sinh trong quá trình vận chuyển. Những báo cáo này rất quan trọng để duy trì tính minh bạch, đảm bảo trách nhiệm và giải quyết bất kỳ tranh chấp tiềm năng nào.
Theo dõi Vị trí:
Vị trí thời gian thực của Người dùng được theo dõi bằng cách sử dụng dữ liệu thu thập được. Chức năng này rất quan trọng để đảm bảo an toàn cho Người dùng và hàng hóa đang được vận chuyển, cũng như để tối ưu hóa hiệu quả lộ trình và quản lý hoạt động tổng thể. Dữ liệu cho phép phản ứng nhanh trong trường hợp khẩn cấp và giúp cải thiện kế hoạch logistics.
Lưu trữ Dữ liệu:
Dữ liệu thu thập được được lưu trữ an toàn để hỗ trợ nhu cầu hoạt động liên tục. Điều này bao gồm việc bảo tồn hồ sơ về hoạt động của Người dùng, nhật ký xác thực và các thông tin liên quan khác. Lưu trữ an toàn đảm bảo rằng dữ liệu được bảo vệ khỏi việc truy cập trái phép hoặc vi phạm, trong khi vẫn sẵn sàng khi cần thiết cho các mục đích hoạt động hoặc tuân thủ.

Dữ liệu của Người dùng có thể được chia sẻ với các thực thể sau:
4.Bảo vệ Dữ liệu
Ứng dụng sử dụng các biện pháp an ninh tiêu chuẩn ngành để bảo vệ dữ liệu của Người dùng khỏi việc truy cập, tiết lộ, thay đổi hoặc phá hủy trái phép. Dữ liệu được lưu trữ an toàn, và quyền truy cập chỉ được giới hạn cho nhân viên được ủy quyền. Người dùng, bất kể họ đã ký hợp đồng lao động với một trong các công ty của Best Inc hay chưa, hiểu và đồng ý với những điều sau khi sử dụng Ứng dụng:
a. Ghi âm Cuộc gọi: ằng cách đăng nhập và sử dụng ứng dụng QTMS Driver Edition, Người dùng đồng ý và chấp nhận rằng các cuộc gọi của họ có thể được ghi âm cho mục đích lưu trữ, kiểm soát chất lượng và quản lý dịch vụ.
b. Lưu trữ Thông tin Cá nhân: Thông tin cá nhân của Người dùng, bao gồm nhưng không giới hạn ở tin nhắn, cuộc gọi thoại và hình ảnh cá nhân, sẽ được hệ thống lưu trữ để hỗ trợ quá trình giao hàng, đảm bảo an ninh và cung cấp phản hồi dịch vụ.
c. Sử dụng ghi âm cuộc gọi và dữ liệu từ tin nhắn và cuộc gọi thoại: Best Inc có quyền sử dụng ghi âm cuộc gọi, ghi hình video, dữ liệu tin nhắn, dữ liệu hình ảnh và dữ liệu cuộc gọi thoại thuộc sở hữu hoặc liên quan đến Người dùng cho các mục đích: (i) xem xét và quản lý hiệu suất dịch vụ; (ii) cung cấp thông báo cập nhật, hỗ trợ khách hàng, và (iii) nâng cao trải nghiệm người dùng mà không cần sự đồng ý của Người dùng. Nếu cần thiết, Best Inc có thể gửi dữ liệu nêu trên cho các cơ quan có thẩm quyền hoặc các công ty liên kết để phục vụ mục đích điều tra hoặc làm bằng chứng trong các thủ tục pháp lý. Best Inc cam kết bảo vệ thông tin cá nhân của Người dùng và chỉ sử dụng thông tin này cho các mục đích được nêu trong các Điều khoản và Điều kiện này.
d. Sửa đổi và Cập nhật: Best Inc có thể sửa đổi các Điều khoản và Điều kiện này khi cần thiết. Các thay đổi sẽ được cập nhật trong nội dung của các Điều khoản và Điều kiện này. Nội dung đã được cập nhật hoặc sửa đổi sẽ có hiệu lực ngay lập tức khi được công bố công khai.
e. Quyền sở hữu trí tuệ:Tất cả dữ liệu cá nhân, bất kể hình thức, được thu thập qua Ứng dụng đều thuộc quản lý của Best Inc. Best Inc giữ quyền sở hữu trí tuệ, bao gồm cả quyền nhân thân và quyền tài sản, đối với toàn bộ giao diện, tính năng, hệ thống công nghệ và thiết kế bố trí kỹ thuật liên quan đến hoặc thuộc về Ứng dụng.

Theo Nghị định 13/2023/NĐ-CP, Người dùng có các quyền sau liên quan đến dữ liệu cá nhân của họ:
6.Cơ sở pháp lý
Điều khoản và Điều kiện này được điều chỉnh bởi Nghị định 13/2023/NĐ-CP về bảo vệ dữ liệu cá nhân tại Việt Nam. Ứng dụng cam kết tuân thủ tất cả các luật và quy định về bảo vệ dữ liệu hiện hành.
7.Thông tin liên hệ
Để có bất kỳ câu hỏi hoặc mối quan tâm nào liên quan đến Điều khoản và Điều kiện này hoặc việc xử lý dữ liệu cá nhân, Người dùng có thể liên hệ [Chèn thông tin liên hệ].
8.Sửa đổi
Điều khoản và Điều kiện này có thể được cập nhật hoặc sửa đổi từ thời gian này sang thời gian khác để phản ánh những thay đổi trong pháp luật hoặc hoạt động của Ứng dụng. Người dùng sẽ được thông báo về bất kỳ thay đổi đáng kể nào đối với Điều khoản và Điều kiện này.
Các luật và quy định liên quan:
1. Nghị định 13/2023/NĐ-CP về Bảo vệ Dữ liệu Cá nhân:
- Điều 4: Định nghĩa phạm vi dữ liệu cá nhân và nghĩa vụ của người kiểm soát và xử lý dữ liệu.
- Điều 5: Phác thảo quyền của chủ thể dữ liệu, bao gồm quyền truy cập, chỉnh sửa, xóa bỏ và rút lại sự đồng ý.
- Điều 8: Chỉ rõ các điều kiện mà theo đó dữ liệu cá nhân có thể được chia sẻ với bên thứ ba.
- Điều 9: Cung cấp hướng dẫn về các biện pháp an ninh dữ liệu cần được thực hiện bởi người kiểm soát dữ liệu.
- Điều 14: Quy định rằng các chủ thể dữ liệu phải được thông báo về quyền của họ và cách thức dữ liệu của họ sẽ được xử lý.
2. Luật An ninh mạng 2018:
o Điều 17: Yêu cầu bảo vệ dữ liệu cá nhân được thu thập và lưu trữ bởi các doanh nghiệp hoạt động tại Việt Nam.
o Điều 26: Quy định việc lưu trữ và xử lý dữ liệu cá nhân bởi các nền tảng số.
Điều khoản và Điều kiện Bảo mật cho Phiên bản QTMS SHIPOWNER
Ngày có hiệu lực:
Điều kiện và điều khoản này sẽ có hiệu lực kể từ ngày 24/09/2024 cho đến khi bị thay thể, điều chỉnh hoặc hủy bỏ bởi một văn bản khác.
1.Giới thiệu
Ứng dụng Phiên bản QTMS SHIPOWNER (sau đây gọi tắt là "Ứng dụng") là sản phẩm của Best Inc. Đối với mục đích của các Điều khoản và Điều kiện này, thuật ngữ "Best Inc" hoặc “Chúng tôi” sẽ chỉ đến Best Inc, cũng như bất kỳ công ty liên kết nào mà Best Inc hoặc các công ty con của nó nắm giữ cổ phần sở hữu.
Các Điều khoản và Điều kiện Bảo mật này ("Thỏa thuận") phác thảo cách chúng tôi thu thập, sử dụng và bảo vệ dữ liệu cá nhân của bạn khi bạn sử dụng Ứng dụng của chúng tôi. Bằng cách nhấp vào "Đồng ý" và sử dụng Ứng dụng, bạn xác nhận rằng bạn đã đọc, hiểu và đồng ý với các điều khoản của Thỏa thuận này.
2.Thu thập Dữ liệu
Chúng tôi có thể thu thập các loại dữ liệu cá nhân sau:

Khi bạn sử dụng Ứng dụng Phiên bản QTMS SHIPOWNER, chúng tôi có thể thu thập nhiều loại dữ liệu cá nhân để đảm bảo chức năng tối ưu và cung cấp cho bạn các dịch vụ được cung cấp bởi Ứng dụng. Dưới đây là phân tích chi tiết về các loại dữ liệu cá nhân mà chúng tôi có thể thu thập:
a.Số điện thoại
Chúng tôi thu thập số điện thoại của bạn trong quá trình đăng nhập để tạo và quản lý tài khoản người dùng của bạn trong Ứng dụng. Thông tin này được sử dụng để xác định bạn một cách độc nhất, cho phép truy cập an toàn vào tài khoản của bạn và cho phép chúng tôi liên hệ với bạn nếu cần, chẳng hạn như để khôi phục tài khoản hoặc hỗ trợ khách hàng.
b.Thông tin đơn hàng
Như một phần của chức năng cốt lõi của Ứng dụng, chúng tôi thu thập và xử lý thông tin liên quan đến các đơn hàng. Điều này bao gồm thông tin về người gửi (người gửi hàng) và người nhận (người nhận hàng). Dữ liệu thu thập có thể bao gồm tên, địa chỉ và các chi tiết đơn hàng khác cần thiết để thuận tiện cho việc theo dõi và quản lý các lô hàng.
c.Thông tin theo dõi logistics
Ứng dụng cung cấp theo dõi thời gian thực của các lô hàng. Để cung cấp dịch vụ này, chúng tôi thu thập thông tin theo dõi logistics, có thể bao gồm dữ liệu về vị trí hiện tại của lô hàng, cập nhật quá trình vận chuyển và thời gian giao hàng ước tính. Dữ liệu này được xử lý để đảm bảo bạn có thể theo dõi tiến trình của lô hàng từ điểm xuất phát đến điểm đến.
d.Dữ liệu phương tiện
Ứng dụng cho phép bạn chụp ảnh và tải lên hình ảnh như một phần của quy trình gửi hàng, chẳng hạn như để xác nhận tình trạng hàng hóa khi nhận. Các tệp phương tiện này được thu thập và lưu trữ để cung cấp tài liệu hình ảnh của lô hàng và có thể được sử dụng cho việc giải quyết tranh chấp, đảm bảo chất lượng hoặc lưu trữ hồ sơ.
e.Thông tin liên hệ

If necessary, Best Inc may submit the aforementioned data to competent authorities or affiliated companies for investigative purposes or as evidence in legal proceedings. Best Inc is committed to protecting the User’s personal information and will only use this information for the purposes outlined in these Terms and Conditions.
d. Modifications and Updates: Best Inc may modify these Terms and Conditions as needed. Changes will be updated in the content of these Terms and Conditions. The updated or modified content will take effect immediately upon public posting.
